Agresión de Rusia a Ucrania: nueva resolución de la Asamblea General de Naciones Unidas


Este 24 de marzo, la Asamblea General de Naciones Unidas adoptó una nueva resolución (véase texto en español, en inglés y en ruso de la Resolución A/ES-11/L.2 reproducido al final de esta nota), titulada "Consecuencias humanitarias de la hgresión de Rusia contra Ucrania", exigiendo un alto inmediado a la ofensiva de Rusia en territorio ucraniano: esta última fue iniciada hace exactamente un mes, en la madrugada del pasado 24 de febrero. 

Es de notar que, en el momento en que se iniciaron los movimientos de tropas rusas el 24 de febrero, el Consejo de Seguridad de Naciones Unidas estaba precisamente sesionando sobre la crisis en Ucrania bajo la Presidencia de Rusia: véase comunicado de Naciones Unidas y acta completa de esta vespertina sesión en Nueva York en la que participaron, por América Latina, los representantes de Brazil y México conjuntamente con las demás13 delegaciones de los Estados que integran el Consejo de Seguridad y el delegado de Ucrania. Este último indicó en plena reunión que:

"Cuando venía hacia aquí hace una hora, mi intención era pedirle al Embajador ruso que confirmara, de forma oficial, que los militares rusos no iban a empezar a disparar contra los ucranianos hoy ni a seguir con la ofensiva. Pero eso ya no sirve de nada desde hace 48 minutos, porque, hace unos 48 minutos, su Presidente declaró la guerra a Ucrania. Por lo tanto, me gustaría pedir al Embajador de la Federación de Rusia que diga, para que conste en actas, en este mismo momento, que sus efectivos no están bombardeando ciudades ucranianas y que no se están adentrando en el territorio de Ucrania. Tiene un teléfono inteligente; puede llamar al Sr. Lavrov ahora mismo. Podemos hacer una pausa para que salga y lo llame" (véase acta S/PV.8974, p. 13 de la versión en español).


La resolución adoptada el 24 de marzo del 2022 : contenido y registro de la votación en breve

Remitimos al lector a esta nota de prensa oficial de Naciones Unidas sobre la resolución adoptada este 24 de marzo. En la parte resolutiva de la resolución, se lee que la Asamblea General:

"2. Exige el cese inmediato de las hostilidades de la Federación de Rusia contra Ucrania, en particular cualquier ataque contra los civiles y los bienes de carácter civil; 

3. Exige también que se proteja plenamente a los civiles, incluidos el personal humanitario, los periodistas y las personas en situación de vulnerabilidad, como las mujeres y los niños;

"2. Demands an immediate cessation of the hostilities by the Russian Federation against Ukraine, in particular of any attacks against civilians and civilian objects; 

3. Also demands that civilians, including humanitarian personnel, journalists and persons in vulnerable situations, including women and children, be fully protected"

3. требует также обеспечить полную защиту гражданских лиц, включая гуманитарный персонал, журналистов и лиц, находящихся в уязвимом положении, в том числе женщин и детей;"

En la larga parte de "considerando" que antecede la parte dispositiva, se lee, entre varios de ellos, que la Asamblea General adopta este texto "Recordando la obligación de todos los Estados y partes en un conflicto armado de respetar plenamente el derecho internacional humanitario, en particular los principios de distinción y proporcionalidad, y la obligación de adoptar todas las precauciones viables para evitar y, en todo caso, reducir al mínimo los daños a los civiles y los bienes de carácter civil, reiterando que los asedios, cuyo objetivo es matar de hambre a la población civil, constituyen una violación del derecho internacional humanitario, e instando a todos los Estados y partes en el conflicto armado a que respeten los derechos humanos, incluidos los de las personas desplazadas por la fuerza, y el principio de no devolución", 

El registro del voto (véase detalle) indica que votaron a favor del texto 140 Estados, 5 en contra (Bielorusia, Corea del Norte, Eritrea, Rusia y Siria) al tiempo que 38 Estados se abstuvieron. 

En lo que respecta a América Latina, entre las abstenciones se registran las de Bolivia, Cuba, El Salvador y Nicaragua; al tiempo que, entre los "No Show" (Estados cuyo representante se ausenta en el momento de la votación) aparece Venezuela, conjuntamente con 9 otros Estados.

Habíamos tenido la oportunidad de analizar el voto anteriormente registrado el pasado 2 de marzo (véase nuestra breve nota al respecto y texto de la Resolución A/ES-11/L.1), en el que se observó un patrón de voto muy similar y la misma ausencia por parte del delegado de Venezuela en el momento de registrarse la votación: notemos que Bangladesh, Guinea Bissau, Irak, y Senegal votaron esta vez a favor, cuando se habían abstenido en la votación anterior de la Resolución A/ES-11/L.1




A modo de conclusión

Esta nueva victoria diplomática de Ucrania viene a aislar un poco más a Rusia ante los demás integrantes de la comunidad internacional.

El pasado 16 de marzo, fue la Corte Internacional de Justicia (CIJ) la que exigió, mediante una ordenanza, a Rusia el cese inmediato de su ofensiva militar en suelo ucraniano. Remitimos a nuestros estimables lectores a nuestra breve nota que concluía indicando que: 

"Se puede adelantar que esta providencia leída por la CIJ este 16 de marzo del 2022 constituye también un primer peldaño en una larga batalla judicial por venir, tendiente a obtener reparaciones e indemnizaciones de parte de Rusia por los graves daños ocasionados a Ucrania: fue la misma intención la que tuvo Nicaragua en 1984 ante la CIJ,  ante la destrucción propiciada, financiada y orquestada por Estados Unidos en su territorio a través de la denominada "contra" nicaragüense"

Consecuencias humanitarias de la agresión contra Ucrania 


La Asamblea General, 

Reafirmando su determinación de preservar a las generaciones venideras del flagelo de la guerra, 

Reafirmando sus resoluciones 46/182, de 19 de diciembre de 1991, y 76/124, de 10 de diciembre de 2021, 

Recordando la obligación que incumbe a todos los Estados, con arreglo al Artículo 2 de la Carta de las Naciones Unidas, de abstenerse en sus relaciones internacionales de recurrir a la amenaza o al uso de la fuerza contra la integridad territorial o la independencia política de cualquier Estado, o en cualquier otra forma incompatible con los propósitos de las Naciones Unidas, y de arreglar sus controversias internacionales por medios pacíficos, 

Reafirmando su compromiso con la soberanía, la independencia, la unidad y la integridad territorial de Ucrania dentro de sus fronteras reconocidas internacionalmente, que se extienden a sus aguas territoriales,

Reconociendo que la ofensiva militar de la Federación de Rusia en el territorio soberano de Ucrania y sus consecuencias humanitarias alcanzan proporciones que la comunidad internacional no había visto en Europa desde hace décadas, 

Reiterando el llamamiento del Secretario General a que la Federación de Rusia detenga su ofensiva militar, así como su llamamiento a establecer un alto el fuego y retomar la senda del diálogo y las negociaciones, 

Recordando su exigencia de que la Federación de Rusia retire de inmediato, por completo y sin condiciones todas sus fuerzas militares del territorio de Ucrania dentro de sus fronteras reconocidas internacionalmente, 

Deplorando las graves consecuencias humanitarias de las hostilidades llevadas a cabo por la Federación de Rusia contra Ucrania, como el asedio y el bombardeo de ciudades densamente pobladas de Ucrania, en particular Mariúpol, y los ataques aéreos lanzados contra ellas, así como los ataques contra civiles, incluidos periodistas, y bienes de carácter civil, en particular escuelas y otros centros educativos, sistemas de agua y saneamiento, instalaciones médicas y sus medios de transporte y equipo, y el secuestro de funcionarios locales, así como los ataques contra instalaciones diplomáticas y lugares culturales, 

Expresando grave preocupación por el deterioro de la situación humanitaria en Ucrania y sus alrededores, en particular por el elevado número de bajas civiles, que incluyen a mujeres y niños, y el número creciente de desplazados internos y refugiados que necesitan ayuda humanitaria, 

Reafirmando la necesidad de proteger, sin discriminación de ningún tipo, la seguridad, la dignidad, los derechos humanos y las libertades fundamentales de las personas que huyen del conflicto y la violencia, independientemente de su condición, a la vez que se promueve la seguridad y la prosperidad de todas las comunidades, y condenando a este respecto cualquier acto, manifestación y expresión de racismo, discriminación racial, xenofobia e intolerancia conexa contra las personas en movimiento, incluidos los refugiados, 

Condenando enérgicamente cualquier ataque dirigido específicamente contra los civiles en cuanto tales y otras personas y bienes de carácter civil protegidos, incluidos los convoyes de evacuación de civiles, así como los ataques indiscriminados y desproporcionados, incluidos el bombardeo indiscriminado y el uso indiscriminado de armas explosivas, y expresando preocupación por los riesgos a largo plazo para la población civil que suponen los daños a la infraestructura civil y las municiones sin detonar, 

Destacando las repercusiones particulares que tiene el conflicto armado en las mujeres y los niños, incluso como refugiados y desplazados internos, y otros civiles que tienen necesidades específicas, como las personas con discapacidad y las personas mayores, y destacando también la necesidad de garantizar el paso seguro, así como la protección y la asistencia, para todas las poblaciones civiles afectadas, 

Expresando su profundo aprecio por los considerables y encomiables esfuerzos realizados por los países vecinos para acoger a refugiados, 

Expresando preocupación por las repercusiones del conflicto en el aumento de la inseguridad alimentaria en todo el mundo, en particular en los países menos desarrollados, al ser Ucrania y la región una de las zonas más importantes del mundo en cuanto a las exportaciones de cereales y productos agrícolas, cuando millones de personas se enfrentan a una situación de hambruna, corren un riesgo inmediato de hambruna o experimentan inseguridad alimentaria grave en varias regiones del mundo, así como en la seguridad energética,

Recordando el vínculo entre el conflicto armado y la violencia, por una parte, y la inseguridad alimentaria provocada por los conflictos y el riesgo de hambruna, por otra parte, y destacando a este respecto que el conflicto armado, las violaciones del derecho internacional humanitario y del derecho internacional de los derechos humanos y la inseguridad alimentaria pueden ser factores que impulsen el desplazamiento forzado y que, a la inversa, el desplazamiento forzado en los países en conflicto armado puede tener efectos devastadores en la producción agrícola y los medios de subsistencia, 

Expresando preocupación por las graves consecuencias humanitarias que tendría un posible accidente provocado por el bombardeo de la infraestructura nuclear ucraniana, reiterando la obligación de garantizar la seguridad física y tecnológica de toda la infraestructura nuclear y expresando preocupación por las repercusiones del conflicto en el medio ambiente, 

Recordando la obligación de todos los Estados y partes en un conflicto armado de respetar plenamente el derecho internacional humanitario, en particular los principios de distinción y proporcionalidad, y la obligación de adoptar todas las precauciones viables para evitar y, en todo caso, reducir al mínimo los daños a los civiles y los bienes de carácter civil, reiterando que los asedios, cuyo objetivo es matar de hambre a la población civil, constituyen una violación del derecho internacional humanitario, e instando a todos los Estados y partes en el conflicto armado a que respeten los derechos humanos, incluidos los de las personas desplazadas por la fuerza, y el principio de no devolución, 

Reiterando la exhortación a todas las partes en el conflicto armado a que acaten las obligaciones que les impone el derecho internacional humanitario en materia de protección de los civiles y los bienes de carácter civil, y el medio ambiente, y a que no dañen los bienes de carácter civil, incluidos los que son fundamentales para prestar servicios esenciales a la población civil, se abstengan de atacar, destruir, retirar o inutilizar bienes indispensables para la supervivencia de la población civil y respeten y protejan al personal humanitario y los envíos utilizados para las operaciones de socorro humanitario, 

Reafirmando los principios de humanidad, neutralidad, imparcialidad e independencia en la prestación de asistencia humanitaria, y reafirmando también la necesidad de que todos los agentes que participan en la prestación de asistencia humanitaria en emergencias complejas promuevan y respeten plenamente estos principios, 

1. Reitera la necesidad de aplicar plenamente la resolución ES-11/1, de 2 de marzo de 2022, titulada “Agresión contra Ucrania”; 

2. Exige el cese inmediato de las hostilidades de la Federación de Rusia contra Ucrania, en particular cualquier ataque contra los civiles y los bienes de carácter civil; 

3. Exige también que se proteja plenamente a los civiles, incluidos el personal humanitario, los periodistas y las personas en situación de vulnerabilidad, como las mujeres y los niños; 

4. Exige además que se respete y proteja plenamente a todo el personal médico y el personal humanitario dedicado exclusivamente a actividades médicas, sus medios de transporte y su equipo, así como los hospitales y otras instalaciones médicas; 

5. Exige que se respeten y protejan plenamente los bienes indispensables para la supervivencia de la población civil y la infraestructura civil imprescindible para prestar servicios esenciales en el conflicto armado;

6. Exige también a todas las partes que protejan a los civiles que huyen del conflicto armado y la violencia, incluidos los ciudadanos extranjeros, en particular los estudiantes, sin discriminación, a fin de permitir su paso voluntario, seguro y sin trabas; 

7. Exige además que las partes acaten su obligación de garantizar el acceso humanitario seguro y sin trabas del personal humanitario y sus medios de transporte, suministros y equipo a quienes lo necesitan en Ucrania y los países vecinos; 

8. Destaca que los asedios de ciudades en Ucrania, en particular la ciudad de Mariúpol, agravan aún más la situación humanitaria de la población civil y dificultan las medidas de evacuación y, por lo tanto, exige que se ponga fin a esos asedios; 

9. Condena todas las violaciones del derecho internacional humanitario y las violaciones y los abusos de los derechos humanos y exhorta a todas las partes en el conflicto armado a que respeten estrictamente el derecho internacional humanitario, incluidos los Convenios de Ginebra de 19491 y su Protocolo Adicional I, de 19772 , y a que respeten el derecho internacional de los derechos humanos y el derecho internacional de los refugiados, incluido el principio de no devolución, según proceda; 

10. Exhorta a los Estados Miembros a que financien íntegramente el plan de respuesta humanitaria de las Naciones Unidas para 2022, el llamamiento urgente hecho por las Naciones Unidas para la respuesta humanitaria en Ucrania y el plan regional de respuesta para los refugiados de Ucrania y los países vecinos, y observa con preocupación las conclusiones del Panorama global humanitario 2022, incluida la actualización de febrero de 2022; 

11. Acoge con beneplácito los continuos esfuerzos del Secretario General, los Estados Miembros, las entidades del sistema de las Naciones Unidas y la comunidad internacional por proporcionar asistencia humanitaria y asistencia y protección a los refugiados, e insta a que prosigan dichos esfuerzos, y acoge con beneplácito también el nombramiento por el Secretario General de un Coordinador de las Naciones Unidas para la Crisis en Ucrania; 

12. Reitera su solicitud al Coordinador del Socorro de Emergencia de que presente un informe sobre la situación humanitaria en Ucrania y sobre la respuesta humanitaria, de conformidad con su resolución ES-11/1, y solicita al Secretario General que la informe, de forma periódica, sobre la aplicación de la presente resolución; 

13. Alienta encarecidamente a que continúen las negociaciones entre todas las partes e insta de nuevo a que se resuelva inmediatamente de forma pacífica el conflicto entre la Federación de Rusia y Ucrania mediante el diálogo político, negociaciones, la mediación y otros medios pacíficos, de conformidad con el derecho internacional; 

14. Decide suspender temporalmente su undécimo período extraordinario de sesiones de emergencia y autorizar a su Presidencia a que lo reanude cuando lo soliciten los Estados Miembros.

Humanitarian consequences of the aggression against Ukraine 


The General Assembly, 

Reaffirming its determination to save succeeding generations from the scourge of war, 

Reaffirming its resolutions 46/182 of 19 December 1991 and 76/124 of 10 December 2021, 

Recalling the obligation of all States under Article 2 of the Charter of the United Nations to refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any State, or in any other manner inconsistent with the purposes of the United Nations, and to settle their international disputes by peaceful means, 

Reaffirming its commitment to the sovereignty, independence, unity and territorial integrity of Ukraine within its internationally recognized borders, extending to its territorial waters, 

Recognizing that the military offensive of the Russian Federation inside the sovereign territory of Ukraine and its humanitarian consequences are on a scale that the international community has not seen in Europe in decades,

Reiterating the call of the Secretary-General to the Russian Federation to stop its military offensive, as well as his call to establish a ceasefire and to return to the path of dialogue and negotiations, 

Recalling its demand that the Russian Federation immediately, completely and unconditionally withdraw all of its military forces from the territory of Ukraine within its internationally recognized borders, 

Deploring the dire humanitarian consequences of the hostilities by the Russian Federation against Ukraine, including the besiegement of and shelling and air strikes in densely populated cities of Ukraine, in particular Mariupol, as well as attacks striking civilians, including journalists, and civilian objects, in particular schools and other educational institutions, water and sanitation systems, medical facilities and their means of transport and equipment, and the abduction of local officials, as well as attacks striking diplomatic premises and cultural sites, 

Expressing grave concern at the deteriorating humanitarian situation in and around Ukraine, in particular at the high number of civilian casualties, including women and children, and the increasing number of internally displaced persons and refugees in need of humanitarian assistance, 

Reaffirming the need to protect, without discrimination of any kind, the safety, dignity, human rights and fundamental freedoms of people fleeing the conflict and violence, regardless of their status, while promoting the security and prosperity of all communities, and condemning in this regard any acts, manifestations and expressions of racism, racial discrimination, xenophobia and related intolerance against people on the move, including refugees, 

Strongly condemning any attacks directed against civilians as such and other protected persons and civilian objects, including civilian evacuation convoys, as well as indiscriminate and disproportionate attacks, including indiscriminate shelling and the indiscriminate use of explosive weapons, and further expressing concern about the long-term risks posed by damage to civilian infrastructure and unexploded ordnance to the civilian population, 

Stressing the particular impact that armed conflict has on women and children, including as refugees and internally displaced persons, and other civilians who have specific needs, including persons with disabilities and older persons, and stressing also the need to ensure safe passage, as well as protection and assistance, to all affected civilian populations, 

Expressing its deep appreciation for the significant and admirable efforts that have been made by neighbouring countries to accommodate refugees, 

Expressing concern about the impact of the conflict on increased food insecurity globally, in particular in the least developed countries, as Ukraine and the region are one of the world’s most important areas for grain and agricultural exports, when millions of people are facing famine or the immediate risk of famine or are experiencing severe food insecurity in several regions of the world, as well as on energy security, 

Recalling the link between armed conflict and violence and conflict-induced food insecurity and the threat of famine, and stressing in this regard that armed conflict, violations of international humanitarian law and international human rights law, and food insecurity can be drivers of forced displacement and that, conversely, forced displacement in countries in armed conflict can have a devastating impact on agricultural production and livelihoods, 

Expressing concern about the grave humanitarian consequences of a possible accident resulting from the bombing and shelling of the Ukrainian nuclear infrastructure, reiterating the obligation to ensure the safety and security of all nuclear infrastructure, and expressing concern about the impact of the conflict on the environment, 

Recalling the obligation of all States and parties to an armed conflict to fully respect international humanitarian law, in particular the principles of distinction and proportionality and the obligation to take all feasible precautions to avoid and in any event minimize harm to civilians and damage to civilian objects, reiterating that sieges, the purpose of which is to starve the civilian populations, are a violation of international humanitarian law, and urging all States and parties to armed conflict to respect human rights, including with regard to those forcibly displaced, and the principle of non-refoulement, 

Reiterating the call upon all parties to the armed conflict to comply with their obligations under international humanitarian law regarding the protection of civilians and civilian objects, and the environment, and to spare civilian objects, including those critical to the delivery of essential services to the civilian population, refraining from attacking, destroying, removing or rendering useless objects that are indispensable to the survival of the civilian population, and respecting and protecting humanitarian personnel and consignments used for humanitarian relief operations, 

Reaffirming the principles of humanity, neutrality, impartiality and independence in the provision of humanitarian assistance, and reaffirming also the need for all actors engaged in the provision of humanitarian assistance in situations of complex emergencies to promote and fully respect these principles, 


1. Reiterates the need for the full implementation of resolution ES-11/1 of 2 March 2022, entitled “Aggression against Ukraine”; 

2. Demands an immediate cessation of the hostilities by the Russian Federation against Ukraine, in particular of any attacks against civilians and civilian objects; 

3. Also demands that civilians, including humanitarian personnel, journalists and persons in vulnerable situations, including women and children, be fully protected; 

4. Further demands full respect for and protection of all medical personnel and humanitarian personnel exclusively engaged in medical duties, their means of transport and equipment, as well as hospitals and other medical facilities; 

5. Demands full respect for and protection of objects indispensable to the survival of the civilian population and civilian infrastructure that is critical to the delivery of essential services in armed conflict; 

6. Also demands that all parties protect civilians fleeing armed conflict and violence, including foreign nationals, notably students, without discrimination, to allow voluntary, safe and unhindered passage; 

7. Further demands that the parties comply with their obligation to ensure the safe and unhindered humanitarian access of humanitarian personnel as well as their means of transport, supplies and equipment to those in need in Ukraine and its neighbouring countries; 

8. Stresses that the sieges of cities in Ukraine, in particular the city of Mariupol, further aggravate the humanitarian situation for the civilian population and hamper evacuation efforts, and therefore demands to put an end to these sieges; 

9. Condemns all violations of international humanitarian law and violations and abuses of human rights, and calls upon all parties to the armed conflict to strictly respect international humanitarian law, including the Geneva Conventions of 19491 and Additional Protocol I thereto, of 1977, 2 and to respect international human rights law and international refugee law, including the principle of non-refoulement, as applicable; 

10. Calls upon Member States to fully fund the United Nations Humanitarian Response Plan 2022, the flash appeal launched by the United Nations for the humanitarian response in Ukraine, as well as the regional refugee response plan for Ukraine and its neighbouring countries, and notes with concern the findings in the Global Humanitarian Overview 2022, including its February 2022 update; 

11. Welcomes and urges the continued efforts by the Secretary-General, Member States, entities of the United Nations system and the international community to deliver humanitarian assistance as well as assistance and protection for refugees, and also welcomes the appointment by the Secretary-General of a United Nations Crisis Coordinator for Ukraine; 

12. Reiterates its request to the Emergency Relief Coordinator to provide a report on the humanitarian situation in Ukraine and on the humanitarian response, in accordance with its resolution ES-11/1, and requests the Secretary-General to brief the General Assembly, on a regular basis, on the implementation of the present resolution; 

13. Strongly encourages the continued negotiations between all parties, and again urges the immediate peaceful resolution of the conflict between the Russian Federation and Ukraine through political dialogue, negotiations, mediation and other peaceful means in accordance with international law; 

14. Decides to adjourn the eleventh emergency special session of the General Assembly temporarily and to authorize the President of the General Assembly to resume its meetings upon request from Member States.

напоминая об обязанности всех государств в соответствии со статьей 2 Устава Организации Объединенных Наций воздерживаться в их международных отношениях от угрозы силой или ее применения как против территориальной неприкосновенности или политической независимости любого государства, так и каким-либо другим образом, несовместимым с целями Объединенных Наций, и разрешать свои международные споры мирными средствами, 

подтверждая свою приверженность суверенитету, независимости, единству и территориальной целостности Украины в пределах ее международно признанных границ, включая ее территориальные воды,

признавая, что военное наступление Российской Федерации на суверенной территории Украины и его гуманитарные последствия имеют такие масштабы, 

выражая сожаление по поводу тяжелейших гуманитарных последствий военных действий Российской Федерации против Украины, включая осаду, артобстрелы густонаселенных городов Украины, в частности Мариуполя, и авиаудары по ним, а также нанесение ударов по гражданским лицам, включая журналистов, и гражданским объектам, в частности школам и другим учебным заведениям, системам водоснабжения и канализации, медицинским учреждениям и их транспортным средствам и оборудованию, и похищение местных должностных лиц, а также нанесение ударов по дипломатическим и культурным объектам,

выражая серьезную обеспокоенность по поводу ухудшения гуманитарной ситуации на Украине и вокруг нее, в частности по поводу большого числа жертв среди гражданского населения, включая женщин и детей, и роста числа внутренне перемещенных лиц и беженцев, нуждающихся в гуманитарной помощи,

подтверждая необходимость защиты, без какой-либо дискриминации, безопасности, достоинства, прав человека и основных свобод людей, спасающихся от конфликта и насилия, независимо от их статуса, при одновременном содействии безопасности и процветанию всех общин, и осуждая в этой связи любые акты, воплощения и проявления расизма, расовой дискриминации, ксенофобии и связанной с ними нетерпимости в отношении перемещающихся лиц, включая беженцев,

 решительно осуждая любые нападения на гражданских лиц как таковых и других находящихся под защитой лиц и гражданские объекты, включая автоколонны с эвакуирующимся гражданским населением, а также неизбирательные и несоразмерные нападения, включая неизбирательные артобстрелы и неизбирательное применение оружия взрывного действия, и выражая озабоченность по поводу долгосрочных рисков, связанных с повреждением гражданской инфраструктуры и неразорвавшимися боеприпасами, для гражданского населения,

подтверждая необходимость защиты, без какой-либо дискриминации, безопасности, достоинства, прав человека и основных свобод людей, спасающихся от конфликта и насилия, независимо от их статуса, при одновременном содействии безопасности и процветанию всех общин, и осуждая в этой связи любые акты, воплощения и проявления расизма, расовой дискриминации, ксенофобии и связанной с ними нетерпимости в отношении перемещающихся лиц, включая беженцев,

решительно осуждая любые нападения на гражданских лиц как таковых и других находящихся под защитой лиц и гражданские объекты, включая автоколонны с эвакуирующимся гражданским населением, а также неизбирательные и несоразмерные нападения, включая неизбирательные артобстрелы и неизбирательное применение оружия взрывного действия, и выражая озабоченность по поводу долгосрочных рисков, связанных с повреждением гражданской инфраструктуры и неразорвавшимися боеприпасами, для гражданского населения,

 подчеркивая особое воздействие вооруженного конфликта на женщин и детей, в том числе в качестве беженцев и внутренне перемещенных лиц, а также на других гражданских лиц с особыми потребностями, включая инвалидов и пожилых людей, и подчеркивая также необходимость обеспечения безопасного прохода, а также защиты всего затрагиваемого гражданского населения и оказания ему помощи,

выражая глубокую признательность соседним странам за значительные и достойные восхищения усилия по размещению беженцев,

 выражая обеспокоенность по поводу влияния этого конфликта на обостряющуюся проблему отсутствия продовольственной безопасности во всем мире, в частности в наименее развитых странах, поскольку Украина и данный регион входят в число наиболее важных с точки зрения экспорта зерна и сельскохозяйственной продукции районов мира, в то время как миллионы людей в ряде регионов мира сталкиваются с голодом или непосредственным риском голода или испытывают серьезный дефицит продовольствия, а также на энергетическую безопасность,

напоминая о связи между вооруженными конфликтами и насилием и отсутствием продовольственной безопасности и угрозой голода в результате конфликтов и подчеркивая в этой связи, что вооруженные конфликты, нарушения норм международного гуманитарного права и международного права прав человека и отсутствие продовольственной безопасности могут служить факторами вынужденного перемещения населения и что, наоборот, вынужденное перемещение населения в странах, охваченных вооруженным конфликтом, может иметь катастрофические последствия для сельскохозяйственного производства и возможности получения средств к существованию,

выражая обеспокоенность по поводу серьезных гуманитарных последствий возможной аварии в результате бомбардировок и артобстрелов объектов украинской ядерной инфраструктуры, подтверждая обязательство по обеспечению охраны и безопасности всей ядерной инфраструктуры и выражая обеспокоенность по поводу воздействия конфликта на окружающую среду,

напоминая об обязанности всех государств и сторон вооруженного конфликта полностью соблюдать международное гуманитарное право, в частности принципы избирательности и соразмерности и обязательство принимать все возможные меры предосторожности для того, чтобы предотвратить и в любом случае с

вести к минимуму ущерб гражданскому населению и гражданским объектам, вновь заявляя, что осада, цель которой состоит в том, чтобы морить голодом гражданское население, является нарушением международного гуманитарного права, и настоятельно призывая все государства и стороны вооруженного конфликта соблюдать права человека, в том числе в отношении насильственно перемещенных лиц, и принцип невысылки,

повторяя призыв ко всем сторонам вооруженного конфликта выполнять свои обязанности по международному гуманитарному праву в отношении защиты гражданского населения и гражданских объектов и окружающей среды и щадить гражданские объекты, включая те, которые имеют критически важное значение для предоставления основных услуг гражданскому населению, воздерживаясь от того, чтобы подвергать нападениям, уничтожать, перемещать или приводить в негодность объекты, которые обязательны для выживания гражданского населения, и уважая статус и обеспечивая защиту гуманитарного персонала и грузов, используемых для проведения операций по оказанию гуманитарной помощи,

 подтверждая принципы гуманности, нейтральности, беспристрастности и независимости при оказании гуманитарной помощи и подтверждая также необходимость того, чтобы все субъекты, занимающиеся оказанием гуманитарной помощи в сложных чрезвычайных ситуациях, поддерживали и в полной мере соблюдали эти принципы,

1. вновь заявляет о необходимости полного осуществления резолюции ES-11/1 от 2 марта 2022 года, озаглавленной «Агрессия против Украины»; 

2. требует немедленного прекращения военных действий Российской Федерации против Украины, в частности любых нападений на гражданских лиц и гражданские объекты; 

3. требует также обеспечить полную защиту гражданских лиц, включая гуманитарный персонал, журналистов и лиц, находящихся в уязвимом положении, в том числе женщин и детей;

4. требует далее обеспечить полное уважение статуса и защиту всего медицинского персонала и гуманитарного персонала, занимающегося исключительно выполнением медицинских обязанностей, их транспортных средств и оборудования, а также больниц и других медицинских учреждений; 

5. требует обеспечить полное уважение статуса и защиту объектов, обязательных для выживания гражданского населения, и гражданской инфраструктуры, которая имеет критически важное значение для оказания основных услуг в условиях вооруженного конфликта; 

6. требует также, чтобы все стороны защищали гражданских лиц, спасающихся от вооруженного конфликта и насилия, включая иностранных граждан, в частности учащихся, без какой-либо дискриминации, обеспечивая для них добровольный, безопасный и беспрепятственный проход; 

7. требует далее, чтобы стороны выполняли свои обязанности по обеспечению безопасного и беспрепятственного гуманитарного доступа гуманитарного персонала, а также его транспортных средств, предметов снабжения и оборудования к нуждающимся в помощи лицам на Украине и в соседних странах; 

8. подчеркивает, что осада городов на Украине, в частности города Мариуполь, еще больше усугубляет гуманитарную ситуацию для гражданского населения и затрудняет усилия по эвакуации, и поэтому требует положить конец этой осаде; 

9. осуждает все нарушения международного гуманитарного права и нарушения прав человека и злоупотребления ими и призывает все стороны вооруженного конфликта строго соблюдать международное гуманитарное право, включая Женевские конвенции 1949 года1 и Дополнительный протокол I к ним 1977 года2 , и соблюдать применимые нормы международного права прав человека и международного беженского права, в том числе принцип невысылки; 

10. призывает государства-члены полностью профинансировать План гуманитарного реагирования Организации Объединенных Наций на 2022 год, чрезвычайный призыв Организации Объединенных Наций об оказании гуманитарной помощи на Украине и региональный план реагирования на проблему беженцев для Украины и соседних стран и с озабоченностью отмечает выводы «Обзора гуманитарной ситуации в мире», 2022 год, включая его обновленные данные от февраля 2022 года; 

11. приветствует усилия Генерального секретаря, государств-членов, учреждений системы Организации Объединенных Наций и международного сообщества по оказанию гуманитарной помощи, а также по предоставлению помощи и защиты беженцам и настоятельно призывает их продолжать предпринимать такие усилия, а также приветствует назначение Генеральным секретарем Координатора действий в кризисной ситуации на Украине; 

12. подтверждает свою просьбу к Координатору чрезвычайной помощи представить доклад о гуманитарной ситуации на Украине и о гуманитарных мерах реагирования в соответствии со своей резолюцией ES-11/1 и просит Генерального секретаря информировать Генеральную Ассамблею на регулярной основе об осуществлении настоящей резолюции; 

13. решительно поощряет продолжение переговоров между всеми сторонами и вновь настоятельно призывает к немедленному мирному урегулированию конфликта между Российской Федерацией и Украиной посредством политического диалога, переговоров, посредничества и других мирных средств в соответствии с международным правом; 

14. постановляет временно прервать работу одиннадцатой чрезвычайной специальной сессии Генеральной Ассамблеи и уполномочить Председателя Генеральной Ассамблеи возобновить заседания по требованию государств-членов.
